Terms of Service

These terms govern your use of the FamSteady website and applications, operated by Latent Ape LLC (“FamSteady,” “we,” “us”). By using FamSteady you agree to them. Plain-English summaries appear throughout; the full text controls.

1. What FamSteady is — and is not

FamSteady helps families coordinate care and stay informed about the wellbeing of the people they look after. It is not a medical device and provides no medical advice, diagnosis, or treatment; its care navigator offers general navigation help only and is not a clinician, lawyer, or financial adviser. FamSteady is not an emergency service — if you believe someone is in danger, contact emergency services immediately. Alerts may be delayed, incomplete, or wrong; FamSteady supplements, and never replaces, human care and professional judgment.

2. Eligibility and accounts

You must be 18 or older to hold an account. You're responsible for keeping your sign-in credentials secure and for activity under your account. Give us accurate information and keep it current.

3. Families, roles, and consent

FamSteady is built around consent. You may invite to your family only people you genuinely know, and you must not use FamSteady to monitor anyone without their knowledge and agreement. Parents and other monitored members connect their own health and financial data, can see what is shared, and may disconnect at any time. Each member sees only what their role permits, and you agree not to attempt to circumvent those permissions.

4. Financial connections

Bank connections are provided through Plaid and are read-only: FamSteady cannot move, hold, or transmit money. By connecting an account you also agree to Plaid's terms. Transaction flags are pattern-based signals, not accusations or financial advice, and may be wrong in either direction — verify anything important with the bank directly.

5. Health data

Health information in FamSteady comes from sources the monitored person chooses to connect (such as Apple Health) and is subject to the consent controls above. Trends, wellbeing summaries, and alerts are informational pattern-detection, not clinical measurements or medical opinions.

6. Acceptable use

• No monitoring anyone without their knowledge and consent.
• No unauthorized access attempts, scraping, reverse engineering, or interference with the service.
• No unlawful use, including harassment or financial exploitation — the thing this product exists to prevent.
• No reselling or white-labeling FamSteady without a written agreement.

We may suspend or terminate accounts that violate these rules.

7. Subscriptions and employer benefits

FamSteady is currently pre-launch; pricing will be published before paid subscriptions begin, and these terms will be updated with billing provisions at that time. Where FamSteady is provided as an employer benefit, the employer pays for access but receives only aggregate participation information — your family's data is never shared with them.

8. Your content and our rights

Your family's data belongs to you. You grant us the limited license needed to operate the service — to store, process, and display the data to the people your family's permissions allow. The FamSteady software, design, and brand are ours and protected by intellectual-property law.

9. Disclaimers

FamSteady is provided “as is” and “as available,” without warranties of any kind, express or implied — including fitness for a particular purpose and uninterrupted or error-free operation. We do not warrant that alerts will catch every problem or that flagged items indicate real problems.

10. Limitation of liability

To the maximum extent permitted by law, Latent Ape LLC will not be liable for indirect, incidental, special, consequential, or punitive damages, or for loss of data, profits, or goodwill, arising from your use of FamSteady. Our total liability for any claim is limited to the amount you paid us for the service in the twelve months before the claim (or $50 if you have paid nothing). Nothing in these terms limits liability that cannot be limited by law.

11. Termination

You may close your account at any time in the app; data deletion follows the schedule in the Privacy Policy. We may suspend or terminate access for breach of these terms, with notice where practicable.

12. Changes and contact

We'll update these terms as the product evolves — material changes will be posted here with a new date, and account holders notified. These terms are governed by the laws of the state of organization of Latent Ape LLC. Questions: hello@famsteady.com.
